The Work Injury Benefits Act (WIBA) in Kenya mandates that all employers obtain insurance coverage to protect against liabilities arising from work-related injuries and diseases. This legislation ensures that employees receive compensation for injuries sustained in the course of their employment, promoting workplace safety and employee welfare.

Key Features

  1. Compensation for Injuries
    • Temporary Total Disability: Employees incapacitated for three days or longer due to an accident are entitled to periodical payments equivalent to their earnings, subject to minimum and maximum limits set by the Minister.
    • Permanent Total Disability: Compensation is calculated based on 96 months of the employee’s earnings, providing financial support for those permanently disabled.
    • Death Benefits: In the event of an employee’s death due to a work-related accident, dependants are entitled to compensation based on a specified amount determined by the Minister.
  2. Funeral Expenses
    • Employers are liable for reasonable funeral expenses for deceased employees, typically capped at a specified amount.
  3. Medical Expenses
    • Employers must cover medical costs related to work injuries, including hospital visits, surgeries, and rehabilitation. This includes transportation costs within Kenya for medical treatment.
  4. Occupational Diseases
    • Employees who contract occupational diseases during their employment are entitled to compensation similar to that provided for physical injuries.
  5. Additional Assistance
    • If an injury necessitates constant assistance for daily activities, additional allowances may be granted by the Director of Occupational Safety and Health Services.

Pricing Plans

  • The cost of WIBA insurance varies based on factors such as the nature of the business and the estimated annual earnings of employees. Basic coverage can start from approximately KES 3,000 per employee annually, with rates adjusted according to risk profiles.

Obligations of Employers

  • Employers are required to register with the Directorate of Occupational Safety and Health Services and maintain insurance coverage for their employees under WIBA.
